The Faculty of Graduate Studies awarded the researcher Rema Joudeh a Master’s Degree in Private Law in response to her thesis entitled “The impact of intellectual Industrial property laws on the pharmaceutical industry A Comparative study”.
This study is concerned about the effect of Industrial Intellectual Property Laws therein the Pharmaceutical Industry where the researcher has dealt with several subjects related to Pharmaceutical Patents: Patents in general and other Patents in particular
Since the research focuses on the negative impact of Industrial Intellectual Property Laws thereupon the Pharmaceutical Industry within the Economic and Sanitary Condition in the developing countries but the status quo requires not neglecting the negative impact trying to find Legal Solutions via understanding the Protectorate adopted by the International Law which has become an integral part therein national legislation, the frame and Legal Approaches that shall be enforced seeking for flexibility to ensure the implementation of International Agreements and Liabilities without Prejudice against the individual regarding the right of Health Care.
The study basically includes the International aspect represented by the Commercial aspects of the Intellectual Property's Rights which is known as:" The Agreement on Trade-Related Aspects of Intellectual Property Rights (TRIPS) in 1994, a number of National Laws enforced in the Countries compared: Egypt, Jordan and Palestine represented by the Egyptian Protectorate Law of Intellectual Property No. (82) in 2002, Jordanian Patents Law No. (32) in 1999, patents and designs rule No. (22) in 14953 in addition to the Palestinian Protectorate Law of Intellectual Property Project in 2012.
The researcher has adopted the Descriptive research therein this research via describing the legal provisions considered along with the legal impacts in addition to studying and analyzing the related jurisprudence dealing with the gaps and problems mentioned within the International Agreements in this regard along with the compared Laws mentioned thereto.
The study sheds light on considering the basics of the Pharmaceutical Patents prior dealing with the exceptional Patents agreed thereto per se a legal prerequisite for understanding the nature of the patents, forms, required conditions there in the Pharmaceutical Industry to be promoted up to the International Patent and Protectorate agreed along with its impact thereupon the Health Research to answer the question related the effect of the Pharmaceutical Protectorate thereupon the Health research in the Developing countries.
The research considers without neglecting the importance of the Intellectual Property Laws therein the status quo regarding the International Patents in the countries compared in addition to considering the Palestinian Legal Status in this regard along with the future impact of Palestinian Accession therein the International Agreements of the Pharmaceutical Patents there upon the Economic and Sanitary Condition in this regard.
The committee consisted of: Dr. Amjad Hassan as a main supervisor and Chairman, Dr. Theyab Alsheikh as an external examiner and Dr. Yahya Falah as an internal examiner.
At the end of the session, the committee approved the success of the researcher and recommended her a Master’s degree.
